What Is Personal Property

What is personal property? Some jurisdictions differentiate between debris and personal property by value. A common value used is $300. If an individual item or an assortment of items would bring $300 or more at a yard sale, then it is personal property.

Some jurisdictions differentiate between debris and personal property by how the items are packaged or not packaged. Clothes scattered around the house are debris, but if they are neatly packed in boxes they are personal property.

Are you starting to see a problem yet? What if we have 500 items of clothing scattered around the house but they should bring $1.00 each at a yard sale. Now, collectively they are personal property.

One last time: talk with your legal advisor and then just do the best you can. You will probably quickly be able to identify things that are obviously personal property and others that are obviously debris – but will a jury of twelve see it the same way you do?
